Arbitration and General Provisions
Any claims relating to the information available on the Web Site ("Claims") shall be governed by the laws of the State of Texas U.S.A., excluding the application of its conflicts of law rules. Any claim or controversy arising out of or relating to these Terms and Conditions shall be settled exclusively by final and binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The Web Site is operated by PREFERRED HOMES PLUS, LLC from its office within the United States. PREFERRED HOMES PLUS, LLC makes no representation that the information in the Web Site is appropriate or available for use in other locations, and access to the Web Site from territories where the contents of the Web Site may be illegal is prohibited. Those who choose to access the Web Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.
Advertising Proofs, Errors, Omissions
Publisher shall be liable for errors only if advertiser's copy was received by copy deadline and proof was returned properly corrected. Preferred Homes Plus, LLC will provide electronic proofs of advertisements to customers. Adjustment for errors will be made by additional publication of the advertisement wrongly inserted. No allowance will be given for omission of a completed advertisement.
Payments
PREFERRED HOMES PLUS, LLC invoices are due and payable by the 12th of each month for current month publication.
Advertising Policy
Publisher reserves the right to approve, revise, or reject any advertisement. All advertising is accepted at the sole risk of the advertiser who agrees to defend, indemnify and hold the publisher harmless against any claim, expense or damage whatsoever suffered by or asserted against the Publisher arising out of the publication of any advertisement at the direction of the advertiser.
Refunds
No Refunds will be issued once payment is received. Adjustments for errors will be made by additional publication of the advertisment wrongly inserted. No allowance will be given for omission of a completed advertisement.
